Fisher v. Texas

Would it be wrong to fight a war of extermination against a separate sentient species? With or without provocation, as in they started the war, and we are just finishing it, or we both compete for the same scarce resources so we wipe them out.

Yeah, not much more I can say beyond that. Nothing bad or tragic, all good things actually, I just didn't have time to tie up loose ends with WebDip in a responsible manner before having to jet. Hope everything is well in this community. I do miss the game and the people, at least most of you! =P Would be interested in seeing if I still know how to play some time.

Affirmative Action

I've been thinking about what herbs to use for my chicken
when I make Mexican wraps. I fry chicken, then add paprika and some corn, mesh some avocados into a good guacamole sauce (some lemon, little garlic, you know) and some "creme fraiche" with mild chili. But now I want to spice up my chicken. Post recommendations here please. :-)

I tried to move army from picardy to wales (move with convoy).
There was only an english fleet in the north sea. Which went to london.
My french fleet is lying in the english channel. When i am ordering to convoy to wales the program refuses... I don't understand...

Jerry Sandusky...
…Got "convicted" to 30-60 years in prison. How a man like him could have the (extremely, I know) remote possibility of living to see daylight outside of bars again is beyond me. Thoughts?

That Norwegian fascist who shot up that summer camp only got 21 years.

While it occasionally leads to what appear to be miscarriages of justice (as in the case of Sandusky and the Norwegian fellow), it's generally better to have shorter prison sentences, rather than longer ones. I understand why they were introduced, the but the three strikes laws have proven to be woeful mistakes. Mandatory minimums have created far worse injustices than have too-short sentences.

He has zero chance of enjoyign freedom even if he did live to see his way out. After all, 100 years old means he will probably be a complete bedridden invalid. And that's assuming they keep him safe in protective custody. Even the most vile of hardcore inmates hate child abusers.

1. Why did you put the word convicted in inverted commas? Are you implying he's only allegedly been convicted?

2. He is 68 years old and must serve a minimum of 30 years in jail. So on his earliest possible release date he will be 98 years old, and since he has been declared a "sexually violent predator" under Pennsylvania law, the authorities would keep very close tabs on him if he was ever released.

That's not exactly true. He was sentenced to what in Norway is called "containment", which in practice is an indefinite sentence. Given his complete lack of remose it is quite likely that he will never be set free, so your suggestion that he will be released in 21 years is mistaken.

It doesn't really matter. He wouldn't last five minutes in general population. Prisoners hate child molesters as much as anyone else.

Ckroberts, I generally agree, and I don't support the death penalty, but I feel like Sandusky's level of evil is far beyond that of the Norwegian terrorist. Before you curve your opinions, hear me out:

• A terrorist has a problem. There's no doubt that something in his brain is way way off, and for that reason, he gains (a little bit of) sympathy from me on the basis that psychological help can turn him into a more productive member in the world.

• Jerry Sandusky had a problem and he knew it. That gains my sympathy. What doesn't gain my sympathy is his obvious lack of effort to fix himself. The terrorist is a tale of psychological inefficiency while Sandusky is a tale of a man who was too voyeuristic to change his mind. He used a charity - MEANT TO HELP PEOPLE - to get victims. That's pathetic.

@Jamie, I put convicted in inverted commas because of what I just said above. He deserves more than just the guilt and shame of having done what he did; I am saddened that there's a possibility he could be back on the streets again, watched closely or not.

Jamie, thank you for the clarification. As I understand it, the minimum sentence is 10 year and the maximum is 21, with the indefinite containment. I guess my point is that his official (?) punishment is only 21 years; any further incarceration would be because he remains a threat to other people, not because of something he did in the past (let me know if I'm wrong about that).

Bo, I agree with you entirely about Sandusky deserving no sympathy. But this is a classic example of an extreme case leading to bad laws. Stuff like this is why people who had sex at the age of 17 with a 16 year old girlfriend, or people who urinated in public, are on the lifetime sexual offender list. It's why somebody sticks up a pizza delivery man and gets a third strike life sentence. Better that a few particularly terrible people should be punished less than we would prefer.

The thirs strike life for robbing a pizza delivery man... I have no problem with that. the guy did something for strikes one and two, and odds are he used a weapon when he robbed the pizza dude. He deserves life for three felonies like that. He is an obvious menace to society.

As far as 17 and 16 year olds having sex, that's actually legal in most states. Hell, 16 is the age of consent in the majority of states as long as the older partner is not an authority figure in the teen's life (parent, teacher, principle, coach, big brother/big sister sponsor, cop, governor, etc.)

We don't even have to go down the road of crimes that are non-violent felonies or shouldn't be crimes at all to see some injustice in your stance. I just can't imagine someone who commits three crimes that, collectively, do not merit life sentence as suddenly, on crime number three, becoming a danger to society.

And after these sorts of situations, there's always a call for some sort of stronger law. They often have names of victims, like that New Jersey law (Pamela's law or something like that) banning bath salts. Usually they are unnecessary, counter-productive, or both. Not to get too political, but the Patriot Act is a good example, as its been far more harmful than any terrorist attack has been. I guess I should be more accurate and say "leading to CALLS for bad laws." I don't know if they've made a new law in the Penn State case.

I would adjust my stance to be three violent felonies (robbery with a weapon is a violent felony) so I can adjust that stance. I don't think possession, for instance, should count as one of the three strikes. But if you commit three violent crimes (crimes involving weapons or that result in physical hamr and/or death to another) then you are a menace to society and had your chance at bat.

@ck.. You bring up a good point.. if I were to have sex with my girlfriend within the 33 days after I turn 18, I'll be on the sex offender list. Thanks for notifying me.

I do think lighter laws are best, but I think some people deserve to be shoved as far away from people as possible. Call me crazy (many people already do), but I think that destroying a life can be - not always, can be - worse than taking a life, and Sandusky certainly destroyed a fair few.

@Draug.. if any old man nursing home were to let him in, they'd better make sure the caretakers are at least 80 years old themselves or he might stare at them.

And there is nothing evil about making a mistake. There's nothing evil about committing a few crimes. After awhile, you can suggest that there is a problem. That's step #2. Once you've identified the problem, you have the opportunity to get help and fix it. That's step #3. If you take the alternate of step #3, you instead satiate yourself through your problem, you are beyond problem. That's evil.

@ckroberts - Yes. I do. He clearly didn't learn from the first two times. So yes, life in prison. He didn't learn after the first two.

@bo_sox - It depends on the state. In Ohio, where I live, as long as there is 4 years or less between the two involved parties, there is no statutory rape. also, as long as the younger is at least 16 and the older isn't an authoritary figure, it isn't statutory rape. Check your state (or country) to be certain what applies to you.

Indiana is 16. Check again. No age gap provision, but if she is already 16, you are good. If she is 15, you have to give her a month to catch up. Can you handle 33 days without knocking boots?

Draug, we'll just have to agree to disagree, then. There's a tiny, tiny number of rare cases that I can imagine earning a, say, 25-year-old a life sentence in prison, and there's nothing common enough that I think it should be a legal minimum.

On March 5, 2003, the U.S. Supreme Court held by a 5–4 majority that such sentences do not violate the Eighth Amendment of the U.S. Constitution, which prohibits "cruel and unusual punishment."[35] In two separate opinions handed down on the same day, the court upheld California's three strikes law against an attack on direct appeal from conviction, Ewing v. California, 538 U.S. 11, and a collateral attack through a petition for habeas corpus, Lockyer v. Andrade, 538 U.S. 63 (2003).

Writing for the plurality in Ewing, Justice Sandra Day O'Connor analyzed the serious problem of recidivism among criminals in California, applied rational basis review, and concluded:


We do not sit as a "superlegislature" to second-guess these policy choices. It is enough that the State of California has a reasonable basis for believing that dramatically enhanced sentences for habitual felons advances the goals of its criminal justice system in any substantial way … To be sure, Ewing's sentence is a long one. But it reflects a rational legislative judgment, entitled to deference, that offenders who have committed serious or violent felonies and who continue to commit felonies must be incapacitated.

In his dissenting opinion in the companion Lockyer case, Justice David H. Souter shot back at the majority: "If Andrade's sentence ... is not grossly disproportionate, the principle has no meaning."[13]

Also, I find it funny that everyone Acts as if every child molester in prison gets murdered in prison if they aren't given protective custody. I find it sad that people act as if that would not be a terrible miscarriage of justice and fault with our already broken penal system.

vDiplomacy
I just looked at the vDiplomacy site someone mentioned below and it looks interesting. However I've tried to register without success—I have yet to receive my validation email nearly an hour after requesting one. I've also tried logging on with my webDiplomacy username, but that doesn't work either.

Does anyone know of a solution?

Atheist/Agnostic Judge for "The Great Debate" Needed
811 posts in, but we're nearly there, we have all the debates submitted to judges...we just have a bit of a problem there.

We had 5, went down to 3, and now we have 4 (it works 2 atheists, 2 Christians, 1 neutral) and we need an atheist judge...so, anyone up for it? (The sooner we scare up a judge, the sooner that thread goes away...?) :)
