Three things:
1) First, I didn't call any justices mediocre. Please quote where I did if you continue to say otherwise.
2) Second, it is fair to ask for more details. However, I'm traveling and am online for only minutes per day (in fairness, I didn't say that). So I'm just not going to do that before I return; but
3) I did point out -- many times -- Roberts's dissent. When I do respond, I won't do so any better than he did. If you've read it and find it unpersuasive, a good start to the conversation will be to point out which parts you found so, so that I may explain why you should not have. Of course, feel free not to. But my point all along has been (1) to summarize to my concern, (2) to point to where an outstanding argument delineating them may be found, and (3) to point out that your counterargument simply fails.
Which it does. Your whole point appears to be that Kennedy said there was an argument, so there must be; and, now, to return to jmo's earlier point that the Supreme Court wouldn't publish it if it weren't true. Both are terrible arguments.
