ESPN Streak for the Ca$h
Anyone here play this with at least semi-seriousness, and is there interest in making a webDip group on ESPN for friendly competition? I haven't been picking too much but with CFB and NFL seasons starting up in a couple weeks, I plan on trying again. I've gotten up to W21 before during football season.

Conway's Game of Life
I suspect many of you are familiar with Conway's game of life, and there may have been a thread on this topic in the past, but I have been messing around with different patterns and I find this 'game' simply amazing. Such simple physics, but such complex and cool things can happen. If you aren't familiar with the game check out the rules here:
http://en.wikipedia.org/wiki/Conway's_Game_of_Life
For those who do know about this, what is the coolest pattern you have seen??

Tony Stewart Accidentally Runs Over/Kills Driver During Race
https://www.youtube.com/watch?v=CtBH9FJ3LOU I have never watched a NASCAR or Sprint Cup race in my life...because frankly, I couldn't care less about cars going around and around in a circle 500 times (I don't doubt it's hugely challenging and takes talent, it's just not for me) but wow...what a way to go. :/ Getting run over like that mid-race, shit...

"Tony Stewart is a world class driver, and if visibility was so poor they wouldn't have had the race. Stewart is a good enough driver to avoid a man waving his arms on a minor league track."

The police are investigating the visibility of the track...and it's not like they had state of the art lights there.

2nd Degree Murder:

"1) an intentional killing that is not premeditated or planned, nor committed in a reasonable "heat of passion"; or 2) a killing caused by dangerous conduct and the offender's obvious lack of concern for human life. - See more at: http://criminal.findlaw.com/criminal-charges/second-degree-murder-overview.html#sthash.0f3otf1Z.dpuf"

Key word INTENTIONAL killing in the first place there...good luck proving that...

"a killing caused by dangerous conduct and the offender's obvious lack of concern for human life"

What specific to Tony Stewart's actions--and not just the act of racing in general--constituted dangerous conduct that's any more dangerous or outside the lines of what's permitted in this kind of racing? Presumably, they have to sign waivers and such acknowledging and consenting to the degree of "dangerous conduct" that comes standard with driving cars that go as fast as that on a track like that (at night)...

What'd he do that was more dangerous than anyone else? Unless they can prove he sped up in an area he didn't have to or did something far outside the bounds of what'd be considered reasonable for a race like this, how would that constitute "dangerous conduct" that's any more so than the set degree of danger that everyone agreed to?

As for Kevin Ward waving his arms...to re-appropriate a famous quote--

What did Tony Stewart see, and when did he see it?

Given just that video, I don't see Stewart-gate coming crashing down on him the way Watergate did on Nixon...there's no smoking gun (or engine) here, you can't prove a thing beyond a reasonable doubt from the evidence already supplied, so unless they find something else...

From what do you make the determination that he's guilty of 2nd degree murder based on the above criteria and the fact that it'd presumably have to be more dangerous conduct than these drivers presumably agreed to and signed waivers for?
Putin33 (111 D)

"Key word INTENTIONAL killing in the first place there...good luck proving that..."

Which is why 2nd portion of the law is the relevant section, reckless disregard for human life, which is what I stated earlier had you paid attention. Accelerating near a man on the track in order to scare him more than qualifies.

"What specific to Tony Stewart's actions--and not just the act of racing in general--constituted dangerous conduct that's any more dangerous or outside the lines of what's permitted in this kind of racing?"

Driving near a man on the track instead of avoiding him like every other driver does, obviously.

"What'd he do that was more dangerous than anyone else?"

Drivers don't run down other drivers on the track.

"From what do you make the determination that he's guilty of 2nd degree murder based on the above criteria and the fact that it'd presumably have to be more dangerous conduct than these drivers presumably agreed to and signed waivers for?"

See above. Just because you acknowledge racing is difficult that doesn't mean you can recklessly endanger people's lives with impunity.

They've had the race there since the 1950s.

So?

Just because it never happened before doesn't mean the capacity for it to happen wasn't there...or maybe other racers weren't so foolhardy as to walk into the middle of a track mid-race?
Putin33 (111 D)
11 Aug 14 UTC
Or maybe they hadn't had a reckless driver with a history of anger issues like Tony Stewart, who recently threatened to run over people.

Obi, it's not worth arguing with him. If most of us had come out against Tony Stewart, Putin would be defending him like he was the patron saint of Mother Russia.
Jamiet99uk (808 D)

@ Putin: Did you look at the video?

"Accelerating near a man on the track"

Judging by the video, I see no evidence that Stewart accelerated to any significant degree as he approached Ward.

"Driving near a man on the track instead of avoiding him like every other driver does"

If you watch the video, the task of every other driver, in avoiding Ward, was easier than Stewart's task, because in the final moments, Ward continues moving into Stewart's path.

The person recklessly endangering Mr. Ward's life was Mr. Ward himself.
Putin33 (111 D)

I've never seen you argue with anybody. It's just insults and demands that people agree with you all the time.

I don't think Putin33's proposal is too outlandish, although his level of certainty is. Short time frames, at least one person raging, large amounts of mass and energy involved, stupid shit can happen. I doubt it was deliberate murder (there wasn't time to even think of that), but the urge to knock back the guy who was getting in his face might have made Tony Stewart forget he was in a race car, instead of a bar.
tendmote (100 D(B))
11 Aug 14 UTC
Also I did not watch the video (I don't really want to see it.)
Putin33 (111 D)
11 Aug 14 UTC
"Did you look at the video?"

Yes.

" I see no evidence that Stewart accelerated to any significant degree as he approached Ward. "

Then why did the car fishtail?

"If you watch the video, the task of every other driver, in avoiding Ward, was easier than Stewart's task, because in the final moments, Ward continues moving into Stewart's path."

He was waving his arms for quite a while Stewart could have easily avoided him. It's not like he ran into the car.
Chaqa (3971 D(B))
11 Aug 14 UTC
tendmote, it's not that bad.
Putin33 (111 D)
11 Aug 14 UTC
He was also standing still when Stewart ran into him. He did not move into the car.
Putin33 (111 D)
11 Aug 14 UTC
Even Stewart's friends say he accelerated, Jamie. The defense is that acceleration is needed to steer in those cars.
Jamiet99uk (808 D)
11 Aug 14 UTC
"Then why did the car fishtail?"

It looks to me like he swerves at the very last moment, and then the car pulls further to the right because the body of Mr. Ward is under the right rear wheel.
Jamiet99uk (808 D)
11 Aug 14 UTC
"He was waving his arms for quite a while"

He is waving his arm in a pointing motion, directly towards the oncoming Stewart. Viewed from Stewart's position, that would not have increased his sillhouette. He wasn't waving his arms out to his sides.
Jamiet99uk (808 D)
11 Aug 14 UTC
Sorry, but if I walk into the path of an oncoming racing car, and it runs me over, that's my fault.
Putin33 (111 D)
11 Aug 14 UTC
The car pulled to the right prior to hitting Ward, because that's what those cars do when drivers accelerate, which can be seen all around the track during the race.

"Viewed from Stewart's position, that would not have increased his sillhouette. He wasn't waving his arms out to his sides."

Viewed from Stewart's position, he could easily have seen a man on the track who had been standing there for quite some time and who everybody else managed to see.
Putin33 (111 D)
11 Aug 14 UTC
"Sorry, but if I walk into the path of an oncoming racing car, and it runs me over, that's my fault."

Except he didn't walk into its path. He was standing still. This happens all the time in racing, and yet nobody is stupid enough to mow somebody down.
WardenDresden (239 D(B))
11 Aug 14 UTC
Putin is right that IF it can be shown that Stewart attempted to scare ward or purposefully drive close to him, THEN it's 2nd degree murder. I don't think any court would take him to trial on that given the difficulty of proving his intentions. Even if he was accelerating, I don't know enough about the physics around these cars to know if that is indicative of intent to hit him.
y2kjbk (4846 D(G))
11 Aug 14 UTC
^^ is it possible that accelerating was actually part of an effort to try to avoid him rather than scare him?
Jamiet99uk (808 D)
11 Aug 14 UTC
@ Putin: "Except he didn't walk into its path. He was standing still."

He absolutely did walk into Stewart's path. He stopped walking once he was in Stewart's path, and was standing still for a few moments before he was hit, but he absolutely did walk into the path of the car.
Jamiet99uk (808 D)
11 Aug 14 UTC
"Viewed from Stewart's position, he could easily have seen a man on the track who had been standing there for quite some time"

I notice you've moved away from saying the arm-waving was important. I take it you now agree that his arm-waving was at such an angle that it would not increase his visibility to Stewart.

"and who everybody else managed to see."

I've addressed that point already. Everybody else was either further away from Ward, or passed him before he had advanced to such a central position on the racetrack. Only one other driver, the driver of the white and blue car, came past after Ward had walked all the way out. None of the other drivers had to take significant evasive action because at the time they passed Ward, he was still close to his crashed car (a much larger and more visible obstacle for them to avoid)
Jamiet99uk (808 D)
11 Aug 14 UTC
Sorry, but if I walk into the path of an oncoming racing car, and then stop for a couple of seconds, and it nonetheless runs me over, that's still my fault.
Putin33 (111 D)
11 Aug 14 UTC
Everybody else was further away from Ward because they didn't intend to drive near Ward, and instead sought to avoid him. None of the other drivers took evasive action because they weren't anywhere near that high up the race track where they could come into contact with Ward.

"I take it you now agree that his arm-waving was at such an angle that it would not increase his visibility to Stewart."

No, not at all actually.
Jamiet99uk (808 D)
11 Aug 14 UTC
Also, Putin, I've watched the video again and timed how long he Ward actually standing still - he is standing still for no more than 1.5 seconds before Stewart's car hits him. Your implied claim that Ward was standing still for any length of time is incorrect.
Putin33 (111 D)
11 Aug 14 UTC
"Sorry, but if I walk into the path of an oncoming racing car, and then stop for a couple of seconds, and it nonetheless runs me over, that's still my fault."

Sorry but if you're a world class driver, you can see human beings on the race track. People get out of card all the time, they don't get mowed down, except in the case of Tony Stewart.
Putin33 (111 D)
11 Aug 14 UTC
"Your implied claim that Ward was standing still for any length of time is incorrect."

You claim he ran into Stewart's path. He did not. You've changed your argument now to be that that isn't sufficient time.

Is it possible for there to be a war where all sides are actually *right*?
We're all familiar with the idea that there are wars in which everyone is at fault. Let's consider the hypothetical opposite: Is it possible for there to be a war where all sides are actually *right*?
(This is somewhat related to the "religious people so anti-humanity" topic but I think this deserves it's own thread.)
