Free speech means the government cannot control your speech (other than certain restricted speech such as inciting speech or sexual speech), but that does not mean non-government institutions (i.e. WebDiplomacy) must follow those rules. Non-government institutions can restrict your speech completely if they want. We're pretty open here, but that does not mean you get an audience. Say what you want, but you go too far, and you may not get to say it here.
There are all sorts of forum features for policing a community, but most of them are not present here as our sparse free developer resources tend to focus on the game improvements/fixes. A standard one to add would be allowing people to report a user through a button - we do it through email, but a reporting function would allow the mods to see if a user was really causing trouble for a larger portion of the community. But I don't see that happening soon. So there we are.

Push-back by certain members of the community has less impact than pure psychology. Humans stake out polar opposite positions naturally. Mods are playing whack-a-mole. Someone new will take the old troublemaker's place. Fortunately, enforcement is the best deterrent, so the new are also less annoying and extreme.
