What does everyone think of Tom claiming con? He claimed prior to Attorney switching over to the non-con side.

The count didn't add up at this point. He asked for the list (so assuming he didn't know the count at that point) and wasn't given it until after he claimed. It was 3 minutes after he asked and he could have found the list. But probably unlikely that he'd have time to really formulate a plan to mess with the count, so I'm assuming he actually is conservative.

If he's town and conservative - no incentive to lie.

If he's scum and conservative - the count at that moment gave him an opportunity to claim non-con and stay out of the heat. Is it worth the risk of being scanned and outed a liar though?

He really hasn't produced enough for anyone to read him content-wise, and we know that he's got the balls to lie as town, why wouldn't it apply as scum?
