The usual rule is that if town votes no-lynch mafia has to kill. Otherwise the game never ends.

That is the down side to a no lynch, increased mafia influence over the lynch at 4-3. However, 5-3 is not much better. At 4-3 or 5-3, we can't afford to have split wagons at EOD.
