Shouldn't you be more worried about how the jury looks at it? The judge in jury trials is just someone who guides the proceedings and makes no decision of innocence or guilt.

I guess in the Hernandez case, some Black NFL players were referred to as thugs, but it was in the same context as White players, so is that OK?

If you want to discuss this out of context, I'm as white as white comes and I get called a thug all the time. I'm a fighter, I guess, but otherwise, I wouldn't characterize myself as a stereotypical thug.

Well when I was growing up, a thug was anyone who chose violence as their only means of conflict resolution, sometimes getting violent just for kicks. The loan sharks muscle was called a thug. If you use the N word, you can be pretty sure race is involved. Now, someone may use the word thug because of race, but I don't think the word alone can be used to determine if there's a racial component.

Agree. Since this is true, members of some racial groups are more likely to be targeted with this word, all else being equal. And that's a problem.

Agree. If someone points out to the speaker that it's problematic to apply to members of some stereotyped groups, and the speaker recognizes the problem, or at least backs off using it while taking some time to think about the point, then it probably wasn't an indicator of conscious racism.

To get to the point, I know plenty of non-white people (that doesn't mean black) that get called thugs, and that, by my own definition, are thugs. I am nothing like them, but I can probably beat the shit out of them so I guess that makes me what they call me. My point is that it's not racial if people don't intend it to be racial and are instead basing it off of other nonphysical traits of a person.
