Well, the tie happened very short before EoD, and I think nobody expected chaqa to show up, given that he is town.

I for once thought it was a pretty slow EoD, and only damo, Brian and myself were there. I missed both Brian's and Chaqa's vote before the clock hit midnight (or phasechange for other timezones), so just to add my mustard (or you would say my two cents I guess), it's not unplausible that he could've just missed it like me.

But it's just a possibility.
